Supreme Court Will Hear Pension Surplus Appeal

On December 6, 2010 affected bargaining agents petitioned the Supreme Court of Canada for leave to appeal
the Ontario Court of Appeal’s decision that the federal government had discretion to expropriate $30 billion
from the Public Service Superannuation fund in 1999.

This application for leave to appeal was granted on May 5, 2011, meaning the Supreme Court of Canada will hear
the case.

The litigants now have 60 days to file its materials with the Court.

We will continue to provide updates on this matter as information becomes available. In the meantime, if you
